Effective as of September 10, 2014, the EB-2 India category became unavailable for the remainder of FY 2014 which ends September 30, 2014. This announcement will have no effect on the priority dates listed in the October Visa Bulletin released earlier this week.
Charles Oppenheim, Chief of the Visa Control and Reporting Division at the Department of State, explained that while this is a rare move, it has become necessary due to the very high volume of EB-2 India cases combined with the annual allocation for EB-2 being reached. As such, there will be no further EB-2 India approvals until the beginning of FY 2015 unless an immigration officer has already requested and received a visa number for a pending I-485 case.
EB-2 India petitions can continued to be filed, however, they will be held for processing until the beginning of FY 2015 on October 1, 2014. Currently pending I-485 cases will have to wait until at least October 1 for status updates.
